The method of evidence and discussion of evidence in criminal procedure

In criminal procedure, some studies are carried out in order to reveal the material truth. The majority of these studies are related to evidence. To dispel any doubt following prosecution and to reach a conviction regarding the defendant, it is necessary to comprehensively gather, preserve, allow discussion of, and evaluate evidence during the trial in such a way that the judge can form a conscientious opinion. This study will focus on the concept of evidence in criminal procedure, the methods of its collection, its impact on sentencing, and its legal significance. The open discussion of evidence in court is regarded as a process to determine whether the facts presented as evidence are admissible. In this context, it is essential that all parties with an interest in the evidence participate in the hearing and have the opportunity to examine the evidence. In Turkish criminal law and procedure, the discussion of evidence is addressed alongside the concepts of obtaining, discussing, and evaluating evidence. This study also distinguishes between the activity of discussing evidence and other procedural actions. The primary objective is to elucidate the significance of the concept of evidence within criminal justice. Additionally, it will be emphasized that criminal proceedings should be conducted in a manner that adheres to human rights while striving to reveal the material truth.
