Judgment and conviction in Criminal Trial

The criminal trial is a common activity, which comen into existence from plea, defense and trial. This activity, begins with a dobt (plea) about commiting a crime, this dobt is overcoming with cooperation of trial authorities participation, ends with giving common judgment when reach to reality of fact.Court and judges, give various decisions in the process of the trial. All decisions given by court and judges, especially conviction and component of conviction have great importance beceuse of as to complete the trial with a very short duration and to supply justice.For concepts of judgment and conviction use instead of one another lots of time, we need to explain concepts of judgment and conviction together. Judgment; is a upper concept which shelters conviction and the other lower categories in its structure, carries a general term quality. Every conviction is a judgment but every judgment is not a conviction. Besides judgment can be given in every stageof the trial. İn such a way that; the court gives the middle judgments which prepares the conviction, much more earlier because of to reach the conviction.In our study, the judgment and the conviction have been assessed in criminal procedure law. The description of the institutions, the qualities of the law, theirs purposes and theirs sorts have been put forwarded. Afterwards, the explication of conviction and to defer the explication of conviction have been explained. The study was concluded with focusing on Miscarriage of Justice.
