Conciliation at criminal procedure

Conciliation is an institution that is considered as an alternative to the criminal justice system which aims to repair the social peace and the relationship between the parties that are deteriorated as a result of the suspect or the accused through taking of the responsibility by the suspect or the accused. In twentieth century,along with the proliferation of mentality of reparative justice, victim rights are found wider place at criminal justice system and as a result by means of taking responsibility of suspect or defendant , conciliation implementations that predict recovery of victim's loss is found place at many countries' laws. One of the countries that include conciliation to criminal justice system is Turkey. Conciliation agency was first given place at our laws with the Turkish Criminal Code nr. 5237. With the following law amendments the scope of conciliation is expanded and provided for institutionalisation, conciliation regained present ou,tlook. Due to the fact that the history of conciliation implementations don't go a long way back ,needs labours about some matters such as ; agency's lacks, comparison with other agencies, different implementation models. With this study,the appearing of the conciliation, along with mentioning some issues like different country implementations,on implementation of conciliation in our country is given point detailed. With the purpose of bringing out of the characteristic features of conciliation agency,comparison of conciliation agency and similar agencies is done.Due to the fact that, conciliation is just a new concept, while aforementioned subjects are being considered as well as legislative arrangements, implementations of judicial authorities and opinions of doctrines are also given place.
