Abstract (EN)

As being social entities, people are equipped with universal rights that they acquire from birth, that cannot be renounced and that will be used without any discrimination. All rights related to human rightsare regulated seperately for children in that they have less power and they are depended on adults physically and mentally. The right to education, which is among the positive status rights, especially makes other rights of children meaningful. Rights such as right tol ive, right to develop, right to work, fireedom of thought are directl or indrectly affected by the use of right to education. The use of te right to education and access to education also includes pre-schooll education. However, children who stay in the prison with their mothers, who are among the disadvantaged groups, have some problems in accessing to pre-school education and in having the right to education. Children can stay together with their relatives or in institutions within the body of the Ministry of Family, Labour and Social Services because their mother is a convict. Besides, they can also stay together with theirmothers in prison. This study discusses the case of Adalet (Justice) kindergartens within the scope of Access to pre-school education for children aged between 0-6, who stay in prison with their mothers, by including such conceptsin the national and international legislations as children rights, historical development of children rights and right to education as a human capital investment for it makes other rights meaningful.
