Abstract (EN)
The main subject of this study has been examine the concept of penal cause which is organized by the Turkish Code of Obligations.In the first chapter of this study, penal clause and the definition of terms have been examined, were then compared with similar concepts in the Turkish legal system has been found in studies.In the second chapter of the establishment of conditions and the types of penal clause qualifications have been evaluated.In the third and final section, the invalidity termination of the penal clause of the conditions are studied.In the results section of this thesis where the relevant assessment has found.
