Abstract (EN)

This thesis examines how the concept of consent in sexual crimes is handled in various legal systems in the context of gender-based violence and how it should be addressed in order to prevent and punish sexual violence in the light of various national and international judicial decisions. The thesis consists of three parts. In the first part, a conceptual discussion is held in the context of gender, the relationship between sex and gender, gender order, gender-based violence and gender inequality are examined. In the second part, the concept of consent is discussed, how consent in sexuality is evaluated in various legal systems and what these approaches mean for gender-based violence are discussed. In the third part, approaches to the relationship between sexual violence and consent are examined in the context of national judicial decisions of Turkey, Canada and England, and individual application decisions of the ECHR and CEDAW Committee.
