Özet (EN)

The principal of pluralist democracy is set as the target of our thesis. When separation of powers, like a signal light, enlightens our way that leads to the target of pluralist democracy, state of law as well paves the way for achieving this goal. In the first section of our thesis, we tried to set forth how the concepts of power, state and law shall achieve the state of law in a sound base; in the second section, what are the foundations and requirements of pluralist democracy which is the target of our thesis; and in the third section, how the principle of separation of powers, which lights our way, can be shaped and how its significance can be asserted. In the course of our study, the power, restriction and legitimacy of the power on the basis of ensuring and preserving fundamental rights and freedoms, status of the jurisdiction, law, equity, justice, prohibition of discrimination, equality and principals of freedom have been prominent issues. By the virtue of the principles that we put emphasis on and tried to explain, we believe that the sense of belonging, for each of the individual who constitutes the society, will come to fruition. In the meantime, we think that the ideal for realization of the happiness of the people at maximum level, and ensuring the public welfare, shall be accomplished by means of the principles which we emphasized in our thesis.
