Abstract (EN)

The new world order which is tried to be constructed in the framework of human rights and democracy after the Cold War oriented the countries to the confrontations on human rights violations occurred in the past. The clash between ?the constructed history with the claim of creating a homogeneous nation? and the collective memory which is rising against it is tried to transform into the national reconciliation by using some processes of the restorative justice. The subject of this work consists of the function of the processes of the restorative justice that is used in order to ensure national reconciliation. In this thesis, the methods such as commemorations, apology, museums, compensations, history commissions, truth and reconciliation commissions, which are hold out of the sanctions of classical law and which are conceptualized as processes of the restorative justice, is examined how they provide the removal of impediments to democratization and how they become important mechanisms to solve conflicts between collective memory, collective identity and official history.
