Özet (EN)

The Aegean Dispute is the serie of problems that we can define such as the breath of theterritorial waters, the delimitation of the continental shelf, the air space, the isolated islandsand islets in the Aegean Sea and the demilitarisation of the Aegean islands which has adefining role in Turkish-Greek relationship. The dispute has also differencies in two partiesabout getting solution. While Turkey see this five issues as the major problems that must besolved between two countries, Greece only recognize the problem about the delimitation ofthe continental shelf by solving them in favor of the International Court of Justice. Greecealso takes full advantage of the EU membership and plays an effective role in the EU to carrythis issues in the court.In the probability of getting these issues in the Intenational Court of Justice, the way to figureout in which issues that Turkey can take advantage is to analyze the dedicated subjects in theInternational Law of the Sea and the precedent jurisprudences similar to Aegean disputes. Theaim of this research is to present an objective way of thinking to this issue with theenlightment of the rules and the solutions of the International Law and by considering thedifferent particularities and historical dimension of the Aegean Sea.Keywords :Aegean Dispute, Continental Shelf, Territorial Waters, AirSpace
