Property ordinance in Eastern-Roman Empire [Byzantine] and its reflections to Ottoman State

In this thesis, in order to reveal the property ordinance in the Eastern Roman (Byzantine) Empire and its reflections on the Ottoman State, well detailed researches have been carried out in the subjects of Roman legal codex that constitutes a large spectrum (Ioustinian Code, Syriac Code of Law, Ecloga, Farmers' Law, Rhodes Maritime Law, Macedonian Edicts, Syntagma and Hexabiblos), Ottoman Codex (The Codes of Mehmet II), History of the Eastern Roman Empire and the Ottoman Empire, History of Property and Economy and History of Church Councils. Historical background has been created by chronologically examining the period between 324-1481, which is the period between the decision of the Roman Emperor Constantine I the Great to found Constantinople and the death of the Ottoman Sultan Mehmed II the Conqueror. Immediately afterwards, in the titled Laws, information was given about the Codex used in Roman and Ottoman Law. Thus, it is aimed to get an idea about historical events and laws before examining the subject of property. Before moving on to the interaction of property, the definition of the property concept and the historical process of property in the Eastern Roman Empire and the Ottoman Empire between 324-1453, the period covered by our study, are explained. In addition, our study outlines the cultural interaction of Byzantine Empire with both European and Turkish history, indicating that the property interaction was not unidirectional. The property interaction has been analysed under the main headings of Pronoia-Timar, Cadastral (Indication-Cadastral Record), Administrative, Taxation, Inheritance and Foundation and the obtained results have been explained.
