Texture and the analysis of 1st 63rd points: In Dürerü?l-Hükkâm Şerhi Mecelleti?l-Ahkam

Ali Haydar Efendi who lived in the last era of the Ottoman Empire and the first years of the Turkish Republic produced significant works in the field of Islamic law. Dürerü?l-Hükkâm Şerhi is a work of the era in which many studies were made on history of Turkish law and it is written as an explanation for Mecelleti?l-Ahkam. Since it aims to complete the literature on the issues of law which are not mentioned in Mecelle, the Dürerü?l-Hükkâm Şerhi Mecelleti?l-Ahkâm has an important role. The thesis consists of three parts. The first includes information about the life and the works of the author. The second part gives information about the resources which the author made use of while analyzing the 1st ? 63rd points in Kavaid-I Külliya part of Dürerü?l-Hükkâm. The third and the last part includes the latinization of 1st ? 63rd, which make up the main theme of the thesis. The points of Mecelle which are mentioned in Dürerü?l-Hükkâm are kept as they appear in the original work whereas the points which are not mentioned are indicated in square brackets [ ] and these points are added by the author of the thesis. In the preparation process of the thesis, special effort was made to be loyal to the original work. The words which exist in modern Turkish are given with their modern pronunciation, and old words are kept as they are used in the era of the book.
