Abstract (EN)
This thesis is a study that was originated from Ali Haydar Efendi?s book of Dürerü?lhükkam. This book, as the most important commentary on the Mecelle is the first example of the civilization in Islamic civil law. This thesis contains three essential sections. In the first section, some information has been provided about Ali Haydar Efendi?s life and his scientific activity and works. In the second section, some general information was about Dürerü?l-hükkam. And particularly the chapter of guaranty (kafalat) has been studied. In this section, the methodology which has been followed by the writer in his writings studied too. In the third and last section of this work, Dürerü?l-hükkam?s chapter of guaranty was latinized. Also in this section, we ascertained the writer?s references in his writing this commentary. Lastly, the original text?s concerning pages were showed in the source. During the latinize, it was devoted to original text.
