Abstract (EN)
The Turkish Commercial Code numbered 6102 (TCC) introduced many changes into the field of unfair competition law, as well as into other areas of law. The subject of this study is "usage of general terms contrary to the principle of good faith", which is considered as a market behavior under the TCC and stated to be an unfair competition practice under the same. This introduction to the TCC, which corresponds to Article 8 of the Federal Law against Unfair Competition of Switzerland, aims to check the usage of the general terms, which has become almost an obligation as per the requirements of the commercial life. Unlike the Swiss law, the general terms and conditions are regulated under the Turkish Code of Obligations Articles 20 to 25. This amendment to the TCC also has the object to regulate the general terms and conditions notion under the context of the unfair competition law.
