Abstract (EN)

Abu Ishaq eş-Shirazi (died 476/1083) is one of the important figures mentioned in the Islamic jurisprudence (fiqh) tradition. He is regarded as an important Islamic scholar both because of his studies and his contributions to the Islamic jurisprudence tradition. One of the leading names of the Shafi'i sect, Şîrâzî, dealt with teaching and copyright services during his lifetime mostly. He made important decisions in the jurisprudence and contributed to the solution of many difficult issues in terms of the jurisprudence in his time. With his scholarly personality, Şîrâzî managed to make himself known in his lifetime and wrote important works in the field of both Islamic law and Islamic jurisprudence method in the context of Islamic jurisprudence tradition. Both the works revealed by Shirazi are the subject of many studies, and his works on Islamic law and Islamic jurisprudence method are accepted as an important reference source for the classical period Islamic jurisprudence tradition. Within the scope of the study, we studied the life of Şîrâzî and conducted a study on his works. Moreoever it is researched which Islamic scholars he had intellectual and scientific communication with in his own time. In the thesis, we tried to deal with Şîrâzî's understanding of nesh, and we examined the meaning that Shirazi attributed to the concept of nesh, the limit of abrogation, the objections made to him in this regard, and his answers to these objections by making use of the works of jurisprudence method which he wrote. In order to reveal Şîrâzî's views on nesh, we initially examined the subject based on his own works. In addition, we examined the other works written on the subject and detailed the subject with the text analysis method. For this reason, we tried to reveal the understanding of nesh of previous and later scholars and Shirazi's views on this subject within the framework of the methodology of Islamic jurisprudence tradition.
