Özet (EN)
In order to reduce greenhouse gas emissions, which threaten the future of our world and cause a big problem called global warming, studies are continuing rapidly on a global scale. Among greenhouse gases, carbon dioxide has the largest share. The main factor in the emission of this gas is the transportation vehicles that move with fossil fuels. All countries of the world have accelerated the production of electric vehicles instead of those powered by gasoline and diesel. In this process, besides technological studies, plans and strategies related to the management of the transition period are prepared and legislative studies are carried out. The main reason for the rapid growth of the global electric vehicle market in recent years is the developments in battery technologies. In this way, "range anxiety", which is the most important reason for hesitation experienced by users when switching to electric vehicles, is eliminated. In addition, the great increase in the number of charging stations installed on intercity roads accelerated the spread of electric vehicles around the world. The main development that paved the way for the electric vehicle market in Türkiye is the announcement of the net zero emissions target for 2053. On this occasion, with the regulation, legislation studies for the transformation of energy source in vehicles started and green development policies were emphasized. For this purpose, widening electric vehicles throughout the country has gained priority. Expanding the use of electric vehicles depends on the establishment of the charging infrastructure. In this context, regulations regarding electric vehicles and charging stations were introduced in 2021 in the Electricity Market Law No. 6446, which is the fundamental law regulating the electricity market, and the Charging Service Regulation published in the Official Gazette dated 02.04.2022 entered into force. With the enactment of legal regulations, which are essential for the development of the charging service market, market actors that will ensure the functioning of the system have also begun to emerge. As a result of these developments, it is expected that the use of electric vehicles will increase and the market will grow. This growth, on the other hand, brings with it a number of question marks. Within the scope of the evaluations in the second part of the study, it has been tried to produce answers to these questions, especially in terms of contract law, consumer and competition law and property law. This study is the first juristical study for the Turkish charging service market. It is hoped that it will lead the studies to be carried out in parallel with the developments in practice.
