Abstract (EN)

Using machine power instead of manpower, reducing costs and increasing production, analyzing, production tracking, safe and fast production, minimizing human-induced errors, less energy and heat consumption, all of the concepts constitute the industry. Employees in industrial organizations may be exposed to occupational accidents due to various factors. Occupational health and safety specialists working in the employer and occupational safety unit have great responsibilities in preventing or minimizing the accidents. After the accidents occur in the workplaces, the legal process starts against the Employer. In this study, the legal dimension of occupational accidents in terms of Employer and Occupational Safety Specialist, the responsibilities of the specialists working in the Employer and Occupational Safety unit within the framework of the relevant legislation were examined and the Supreme Court decisions were evaluated. Related concepts such as how occupational accidents are explained in the relevant legislation provisions and legal system, appropriate causal link, negligence, intent, fault and liability, material and moral compensation elements were discussed in detail. As a result, the parties in the field of occupational health and safety were determined and their rights, obligations and responsibilities were examined within the framework of the provisions of the legislation and evaluated with examples from the Supreme Court decisions.
