Energy investments and international standarts of treatment

The subject of this study is ?The Protection of Energy Investments in International Investment Law?. The issue of promotion and protection of investments are mainly regulated in bilateral and multilateral investment treaties in international law. In historical process, the increasing impact of some activity areas upon domestic and global economy, pave the way for making international regulations on these areas. The energy investments have a great significance among the above mentioned activities. In this context, within the scope of constituting a legal structure for a liberal energy market and energy supply security, the Energy Charter Treaty, signed in 1994, is the most important step to promote the coordination on energy Sector at an international level.The analysis of the concept of investment and investor in international investment law has a special meaning within the context of energy investment protection. It is essential to explain these concepts for both determining the execution area of Energy Charter Treaty and establishing the jurisdiction of the arbitration tribunals. Because, the arbitration tribunals primarily investigate the presence of investment and investor at investment disputes, then in accordance with this decision they decide upon their Jurisdiction.In order to protect the foreign investor against any poitical risk factor at home/capital importing state, the Energy Charter Treaty has established some basic treatment standarts which the home states are obliged to comply with. Under the head of these standarts; the prevention of illegal expropriation, fair and equitable treatment, protection and security and anti-discrimination principles have taken place. National treatment and most favoured nation treatment clauses are handled in the scope of anti-discrimination principle at the Energy Charter Treaty.
