Abstract (EN)

Contract of work, one of the most common contracts in human life, regulates the relations between job owner and contractor, and imposes a number of obligations, burdens and rights to the parties. It is important how parties will act in case the work commissioned by the job owner in the contract formed defective by contractor. The main subject of this study is to concentrate on the defects occurred in the work under the contract and what the obligation of notify relating to the defects is. The defect in the contract of work may arise from the lack of the qualifications that the parties have agreed upon within the contract, but it may also occur because of the lack of qualifications that are not agreed upon by the parties, yet should be in the work in accordance with the principle of honesty. The notification of defects of job owner in the work includes declarations that the contractor's action is contrary to the contract and that the contractor will be held responsible for the defective work. If the job owner does not declare the defects in the forms and conditions recognized by Law, job owner will have to bear the responsibility of the defective work. During the study, comprehensive literature review, judicial decisions and doctrinal differences have been examined. Key Words: Work, Contract of Work, Defect, Notification.
