Özet (EN)

This thesis is written regarding, preparation, submission and evaluation of tenders on behalf of Law No: 4734 Public Procurement Law.In the content of the thesis, general outlines of procurement law is argued while Turkish Procurement Law system is compared to European Union Procurement Law.After giving these general information, general principles of Public Procurement Law which are used during the evaluation of the events emanating from conflicts of procurement law, are touched on separately.While representing the general principles, the connection of these principles is pointed out. For example, if there is no competition during tender process, there is no mean of the principle of equality; also, if there is no privacy, we can say that the principle of competition is formal.The tender process is separated into two ways as the preparation of tenders and the evaluation of tenders. The submission of tenders and the evaluation of tenders are both considered in the same section. The equality, which is the basic principle of procurement law is the spine of this thesis. In the content of the thesis, this principle is firstly considered as a concept of procurement law and then underlined the importance of this principle regarding tender process. During the preparation of tenders, the principle of equality is equated with the principle of competition in the nature of this principle while argued as the principle of equal transaction during the phase of evaluation of tenders.Consequently, for the purpose of choosing the most advantageous tender, which is called as ?the best price?, the ideas which are about the acts of the the people who acts in the name of the government during procurment of goods, are evaluated under the concept of equality.
