Abstract (EN)

The subject of this study is the criticism of the decisions of the Constitutional Court in terms of feminist legal theory. The study has two main aims. The first is to make it possible to look at constitutional law from a different and more egalitarian perspective by revealing the criticisms of feminist theory towards law. The second is to reveal the problems of the Constitutional Court's judgements in terms of existing inequalities based on this feminist perspective and thus to contribute to the more egalitarian writing of the Court's future judgements. In this study, the Constitutional Court's judgements on gender identity, first and last name are analysed and the Court's perspective on gender and gender norms is evaluated. At the same time, answers are sought to the questions of which rights the Court considers subject-related issues, how it applies the criteria for the limitation of fundamental rights and freedoms, whether it takes into account the sources of international law on equality, and finally, whether there is a difference in approach between its norm review decisions and individual application decisions.
