The rights protected by the Law on Intellectual and Artistic Works, in case of violation of these rights the civil cases that may be brought action and proceedings

The humanbeing is capable of thoughts whom produces intellectual and artistic works by using this ability, the rights on these intellectual and artistic works are protected by The Copyright Law of Turkey. Right holders have the right to open legal cases due to the violation of the rights of these works which are included into the category of intellectual and artistic works that counted in The Copyright Law of Turkey. Because of the subject of our thesis is proceedings of the civil cases opened according to The Copyright Law of Turkey, primarily according to the Copyright Law of Turkey, what are works, the types of works, who is the owner of the work and the owner?s rights are explained briefly in thesis; because the judge, from the front of the file case due to a violation of the intellectual property, first should investigate whether the person who claims the violation of rights is really the owner or not and also judge should investigate whether the intellectual property which is the subject of the case are in the categories of works stated in the Copyright Law of Turkey or not. In the continuation of our thesis, after explaining the which civil cases can be opened and under what circumstances these civil cases can be opened according to The Copyright Law of Turkey, the proceedings of these civil cases are explained in detailed. When there is no provision in The Copyright Law of Turkey about the subject, the subject is explained by the 6100 numbered Code of Civil Procedure's provisions .
