The tahsīniyyāt in context of maqāsid thought in fiqh methodology

Tahsīniyyāt is a concept that expresses the verbs that are beautiful, pleasing to the eye, natural, admired, perfect, and that signify good deeds in the Sharī'a. Tahsīniyyāt, as a fiqh methodology term, appears in the third level of maslaha. In terms of its position at the level of maslaha, tahsīniyyāt is a maslaha that expresses the highest point in behavior, the highest morality, piety in religion, the most beautiful state of things and the peak of civilization. Maslaha provides the protection of the five essential principles (religion, life, mind, generation and property) that must be protected at the essential, pilgrimage and estimation level. The main one of these levels is zarūriyyāt. For example, for the protection of life, one's eating, drinking, dressing and sheltering is from zarūriyyāt. It is permissible for a helpless person to eat the forbidden food until they die, because it is from the hājiyyāt of protection of the soul. Forbidden to eat and drink dirty and disgusting things and to eat clean and delicious foods are examples of tahsīniyyāt. Each level is protective around the other. In terms of preserving the five essential principles, preserving the level of tahsīniyyāt is as important as preserving the essentials and hājiyyāt. Because, when the level of tahsīniyyāt disappears, over time, hājiyyāt and zarūriyyāt also face the danger of disappearing. Although the level of tahsīniyyāt is not indispensable for a society, it is impossible for a society to reach the level of civilizations without tahsīniyyāt. The highest level of an object, the perfection point of an individual, and the attainment of a society to the peak of civilization are possible with the existence of tahsīniyyāt.
