EU migration policy in the light of recent developments

The process of creating EU common migration policy started in the 1990s. The EU's common migration policy, on the basis of the determination of the minimum standards for the Member States in the field of immigration, covers a policy-making process, especially against irregular migration. Although the European Commission and the European Parliament often advocate that it is necessary to establish a comprehensive immigration policy that protects immigrant rights in the process of establishing a common migration policy in the EU, the policy making process and its implementation in this area continues to lie in the initiative and the national interests of the EU Member States. The question of the fair and equal sharing of responsibility and burden among the EU Member States has dragged big crisis in the EU along with the asylum seekers. Along with the sudden refugee crisis of the European Union after the Arab Spring, the Union needed to make serious changes in its migration policy and to reform this policy. The determination of the Member State responsible for reviewing an asylum seeker's application is materialized by the so-called Dublin system. The Dublin Convention, which first entered into force in 1997, was inadequate in responding to asylum seekers and refugees in time and needed reform. These processes of reform have yet been inadequate to solve the crisis and have become inoperable among the Member States. Undoubtedly, as long as the criteria of the country of first entry under the Dublin system is preserved, the EU's external border countries will continue to face a disproportionate burden. This principle should be amended on the basis of the principle of fair sharing in the Article 80 of the Lisbon Treaty. Multilateral immigration policy, addressed to the source, transit, target country and immigrants, will be a process for the benefit of all parties.
