Examination of today's informed patient consent forms in comparison with Konya şer'iyye kadi registry aceptance forms between 1563-1673

Introduction and Objective: Although the informed consent is a very important issue in terms of human rights, its effectiveness and adequacy in terms of meeting the required norms has been a controversial issue. In this study, we aimed to identify findings that may be useful in today's practice by comparing the aceptance forms arranged in Konya between 1563 and 1673 with today's patient informed consent forms. Materials and Methods: Chronologically, the aceptance forms were selected by reviewing the transcriptions of the first 20 (110 years) Konya Şer'iyye Kadı Registers. Then, these documents were reviewed by comparing them with today's informed consent forms in terms of content, legal responsibility and figure. Results: It was determined that a total of 49 consent records were prepared for 51 people, the most common aceptance forms was arranged for an inguinal cleft in 60.7% (in 31 people) and testicular diseases in 17.6% (in 9 people), and the patients stated their diseases after the statement "said" at the presence of the judge and witnesses. It was observed that 92.1% (47 people) said that if they were cured, they would pay the fee to the physician, and if they died, 70.5% (36 people) most frequently used the phrase "if I die, the physician would not be aggrieved" Discussion and Conclusion: In today's informed consent forms, the physician gives information about the disease and the patient is asked "I have been informed." While a statement was being taken, it was determined that the patient informed the court about his illness and treatment in the aceptance forms. Today, while the physician must prove the existence of the patient's informed consent form, the fact that the kadi opens her notebook and looks at the aceptance forms constitutes the most important difference in practice between today's informed consent forms and aceptance forms. The presence of the Kadi at every stage of the consent process, not just in case of a lawsuit, may have caused aceptance forms records to be kept meticulously and society to attach more importance to patient consent. Today, we believe that the presence of xii hospital lawyers in the routine of the process of obtaining informed consent with new legal regulations and the establishment of special courts implementing health law first and then health law will contribute positively to the problems experienced.
