Invasion of a place (TCK M. 154)

Asset values constitute one of the basic values of society. Regulation on invasion of a place or in other words trespassing, (article 154 of Turkish Criminal Code) which composes the subject of the study, aims to protect some of these assets. The regulation is framed in three paragraphs and each paragraph issues includes a different type of crimes. Via this regulation property values are protected against violations occured through immovable properties. The study consists of two parts. In the first chapter, the concepts of property and possession and the ways of their protection in other branches of law, the law no. 3091 concerning the protection of immovable property and the regulation of invasion of a place in the law no. 765 are examined. In the second chapter, the types of crimes mentioned in article 154 of law no. 5237 is analyzed. The crime regulated in the first paragraph of article 154 is the occupation of privately-owned immovable properties by a person acting as if he or she is the owner, changing or destructing the boundaries of the property and preventing the rightful owners from benefiting from the immovable property. The crime defined by the second paragraph is confiscation or management or usage with agricultural purposes of the immovables belonging to the village administration or allocated to the common use of the villagers. In the third and final paragraph, the crime that is regulated arises when a person changes the water-duct regardless of its ownership.
