La loi applicable et la juridiction compétente en matière de la concurrence déloyale applicable law and jurisdiction in unfair competition

The establishment and keeping of a fair competition which is one of the main elements of the commercial life depends on a due execution of the unfair competition provisions in national and international area. The unfair competition provisions have a very important role in the maintanance of a "fair economic competition" because they assure the interests of the competitiors, clients and all the market. Taking into consideration the actual marketing techologies, the international unfair competition conflicts became more important in the international commercial field. The most frequent problems in this kind of conflicts are the determination of the applicable law and the jurisdiction. This thesis aims to study these problems which have to be resolved by the Turkish judgement.
