Abstract (EN)
In this thesis, the consensuses in the field of family law in the Hanbali sect were identified and their legal status in the eyes of the other three sects was tried to be revealed. This study aims to abstract from the discussions about ijma and to reveal how the other three sects characterize an issue that the Hanbalis define as ijma. In this context, in the first chapter, the ijmas seen in the Hanbali literature on the obstacles to marriage in the pre-marriage period, the pillars of marriage, its conditions, and the issues of sermon and wedding were identified and analyzed. Following this, in the second chapter, relevant ijma's were identified and analyzed under headings such as dowry, âlimony and hidane in the context of the post-marriage process. In the third part, within the scope of the process of dissolution of marriage, the Ijmas seen in the Hanbali literature were determined on the axis of the concepts of talaq, termination, ila, zihar, muhalea, mafkud, iddat and ihdâd, and the approaches of other sects regarding these ijmas were analyzed, and the research was completed by presenting the data obtained in the conclusion section.
