Abstract (EN)
One of the most instigations of our century is some people who are away from science ignore the Hanafi figh school's forou (subsidiary) part which is brought up by Imam Abu Hanifah and his students based on Hadith and Sunnah and also ignore the historical reality. These people defined imam Abu Hanifah and his sect with some slanders and they claimed that the Hanafis in their fatwas are not based on Qur'an and valid Sunnahs. These people also asserted that they're relied upon rumours and weak hadiths. This wrong claim of them is just because of their ignorance of Hanafis methods and bases. Imam Abu Hanifah's attitude towards the valid hadiths shows that he did not belong to Ahl al-ra'y who are disparaged by predecessor scholars. It's an undeniable reality that he is the same with the other scholars as he accepts Hadith and Sunnah as the basic source when judging. We, in our thesis, aimed to establish the Hadiths that opposed to other three sects (Maliki, Shafii, Hanbali) by analysing the "Book of Pilgrimage/Kitab al-Hajj" from the "I'la' al-Sunan" written by Indian scholar Zafar Ahmad al-Osmani et-Tahanawi (1394/1974). We tried to establish the sources of hadiths about Hajj that is one of the five pillars of Islam basing on "I'la' al-Sunan" and to prove that claims and imputations against Hanafis mentioned above are not true with the evidences by analysing of hadith sources about Hajj. Within this framework, the related parts in the hadith books especially Kutub al Tis'ah are determined and commented on the grounds of Hanafi School leading Imams hadith criterion. It's tried to be analyzed in the context of Hajj, the four schools when critisizing each other which subjects they're relied on mostly and reasons and justifications of their oppositions. In our thesis it is analysed how the Hajj is performed today, how much the existing practice and the hadiths match up with each other and solution suggestions for the problems are presented.
