Asserted hila al-shariyya's (legal stratagems) in the field of family law by hanafi's

This thesis covers the environment in which the Hila al-Shariyya's are formed, the reason of occurance its origin, its basis; the definition, nature and the views of the sects about this subject, the evidences and especially the asserted Hila al-Shariyya's by the Hanefi sect in the field of Family Law. In the first part of the study, it is discussed that the relationship between moral and law of hila al-shariyya; tried approach to hila al-shariyya from a general perspective of practice, intention and act; the definition, essence of the hila al-shariyya, provided opinions and evidences by sects about this subject are mentioned. In the second part, general informations are given about marriage and divorce in the field of Islamic Family Law. In addition, marriage, divorce and issues within these subjects according to point of view of Hanafi are involved. In the final part of the research, overall evaluation is carried out.
