Legal liability of the air carrier for the damages resulting from the delay of the passenger transport within the scope of airline passenger transport contract

The passenger constitutes the most important element in the air transport, excluding cargo transport. In this type of transportation, which is widely preferred by the passengers as it developed rapidly starting from 20th century, many problems and complications can naturally occur. Perhaps the most important of these is the delay. In the case of air passenger transport, it may be possible for both passengers to have a delay at the departure point, i.e. a retard, or a delay at the point of arrival. In the event of both delays, passengers usually suffer damages. There should also be at least some rights that should be recognized even if they do not suffer any damages. It is very important to determine the legislative provisions which will be applied in municipal and international law and to apply the relevant provisions in the most accurate way and to eliminate the grievances of passengers who used air transport because they thought it to be faster and more efficient than other types of transport. In addition, these determinations are important not only for the passenger, but also for the air carrier which is conducting the air transport business, so that the legal responsibility vis-à-vis the passenger is predictable. In this study, the scope and criteria that can be compensated for the losses arising from the delay in departure and arrival points are discussed. In addition, solutions were tried to be presented in which way other rights other than compensation should be established.
