Abstract (EN)
The development of medical science has led to an increase in the trust in physicians, and accordingly, the rate of patients applying to physicians has increased. This situation has also brought up the issue of 'the liability of the physician resulting from the medical intervention applied'. The subject of our study is the examination of the compensation liability of the physician resulting from medical intervention within the framework of private law. Our study consists of three main sections. In the first section, the conditions for a legal medical intervention are discussed. In the second section, the sources of the physician's legal liability are examined separately under contractual liability and non-contractual liability. In the third and final section, the physician's compensation liability and the procedural rules in compensation lawsuits are discussed. In order to limit the scope of the subject in our study, the physician's liability within the framework of private law has been examined, and administrative, criminal and disciplinary liabilities have been excluded.
