The position of school of Hilla in the Shiīte-usūlī tradition: The case of Muhaqqīq al-Hillī

One of the important turning points affecting the Shia-Imamiyyah is that Usūlī thought, which moved to Najaf after the Shiite Buwayhids lost Baghdad, entered a period of stagnation due to various reasons. The science center that ended this stagnation was Hilla. The scientific activities led by Ibn Idrīs al-Hillī (d. 598/1202) in Hilla were strengthened after Hulagu gave amān to this city and Shiite scholars came from the surrounding cities. In this period, which marks the beginning of the second brilliant period for Usūlīs, Muhaqqīq al-Hillī (d. 676/1277) was the leader of the Shiite scholars. This study which consists of two parts, focuses on the effects and contributions of Muhaqqīq al-Hillī's views on fiqh, fiqh methodology and kalam to the Usūlī tradition. In the study, the city of Hilla and Hilla school are also mentioned. According to the results, al-Hillī took some important steps that would last for many years in Usūlī thought with the scholars and his students. His work of fiqh, which he wrote with a new classification unlike former ulama Sharā'i' al-Islām and the work that enabled the adoption of ijtihad by the Shia Ma'ārij al-usūl played an important role in this tradition. He adopted a more moderate style compared to the harsh fatwas of Ibn Idrīs al-Hillī and he saved the Imamī tradition from the anti-Tusī attitude. During the occultation, his fatwa that the faqih can perform the Friday prayer, the emphasis on faqih with the title of nāib about hums, to authorize faqih to hudud punishments without making any records contributed to fuqaha for gain the right of general niyabāt.
