Abstract (EN)

Developments in artificial intelligence affect almost every area of human life. Like other fields, it is not possible for the law to remain detached from these developments. As a matter of fact, with the developments. In the field of artificial intelligence, it is becoming more and more desirable for artificial intelligence to find a place in the law. The emphasis here is that the effect of artificial intelligence is not only causing change but transformation. In this regard, artificial intelligence has the potential to be disruptive to traditional understandings of law. However, how artificial intelligence will affect the law depends on the developments in the field of artificial intelligence, as well as on the discussions in the field of law. In this context, it is important to examine the relationship between artificial intelligence and law. This study was conducted to determine the current and possible effects of artificial intelligence in the field of law. In the study, "Is it possible for artificial intelligence to be a judge?" and "What kind of results will arise if artificial intelligence is used in law?" were investigated. In this context, after analyzing the theoretical framework of artificial intelligence and related concepts, examples of current applications in law are given and consequences of the application of artificial intelligence in law are evaluated. In the study, it was first concluded that it is not possible for artificial intelligence to be a judge within the framework of existing facts. The reason for this conclusion is that it appears to be a categorical impossibility due to the basic working principles in existing artificial intelligence models. Secondly, it has been concluded that if artificial intelligence is used in law, a paradigm shift will occur and results that are incompatible with the traditional understanding of the law may arise, possibly causing violations of rights. There is a big difference between the principles of artificial intelligence itself and the legal reasoning process. This difference has the potential to harm certain values that the law is traditionally orientated towards and tries to protect. On this basis, developments in the field of artificial intelligence should be considered from the perspective of the law itself before being applied to the law. In this study, the theoretical framework of artificial intelligence is outlined in general terms through document analysis, and its relationship with the law is analyzed by taking into account the examples in practice. In this regard, it is intended to contribute to the literature in a theoretical and conceptual aspect.
