Özet (EN)

This study will examines the role of functional administration in the rule of law within the framework of state, civilization and legal administration. In the first chapter, the concept of state will be explained by using its etymological foundations. In addition, the evolution of the modern state, the Islamic state and the Turkish state is explained. Sources of sovereignty and the relationship between power, legitimacy and consent are examined. In addition, the relationship between civilization and culture, the theory of asabiyyah, social morality and justice are also evaluated. In the second part, the concepts of law and state are compared. The meaning of the rule of law and its content and formal elements are mentioned. The principle of legal administration, which is a requirement of the rule of law, is specifically explained in the context of its theoretical origins and being based on the law and not being agaıinst the law. In the Third Chapter, the concept of functional administration has been explained comparatively and the duties of functional administration in the rule of law have been examined.
