Abstract (EN)

Trial expenses refer to the expenses that must be incurred in order for a dispute to be heard before the court and for the judgment to be finalized. Our study focuses on the costs of the proceedings that must be paid by the parties to the lawsuit and the responsibility of the parties for these costs of the proceedings. In the first part of our study; the definition of trial expenses, the purpose of taking trial expenses and the scope of trial expenses are examined in detail. In the second part of our study, the principle of liability for trial expenses, which is our main subject, is examined within the framework of the Code of Civil Procedure No. 6100, the decisions of the Court of Cassation and doctrinal opinions as the liability for trial expenses in terms of rules on liability, special circumstances arising from procedural law, procedural final decisions, final decisions on the merits and some special types of cases. This study has been written in order to eliminate the confusion and prevent uncertainties in practice.
