The structure and functioning of the European Common Security and Defence Policy in a legal aspect

The European Union has been trying to form a "Common Security and Defence Policy" since the 1990's. This policy, which has been gaining more and more importance in the period from its involvement in the founding treaties to the present, differs from the other policies of the European Union in many aspects. This policy, which differs from the supranational structure of the European Union, is carried out in a different legal process. Our study was devoted to the examination of this process, which is different from other policy areas of the European Union. Our study consists of three parts. In the first part, the definition of common security and defence policy and its appearance in the founding treaties since the establishment of the European Union have been discussed. In the second part, the decision procedure of common security and defence policy are examined. The Union's institutions involved in the decision-making process and the various institutions and organizations involved in this policy are addressed. In the third part, military and civilian operations carried out undercommon security and defence policy are examined. The legal basis of operations and its relations with the United Nations have been discussed and examples of implementation are given. A military and a civilian operation were examined in detail and the decision making and implementation processes were tried to be expressed.
