Trial procedure in cases of re-employment

The reason for the emergence of Modern Labor Law is that employee need extra protection as they are in a weak position. The main aim is to ensure social justice and to preserve social balance. The employee is dependent on the employer and is subject to his authority. The unpaid wage is the source of employee's and his/hers family's livelihood and the continuity will be attained by his work. Therefore, the employee is economically dependent on the employer. Putting into practice the right of work guaranteed by the Constitution, maintaining the existence of the labor relations between the employee and the employer, ensuring the continuity, setting the rules and controlling the fairness of these rules are very important to maintain the existence of a labor relations between the employee and the employer. As a matter of fact, the issue of this study is how to implement these provisions with the provisions of Labor security, which have been brought to ensure that the employees feels safe in the direction of his / her employment relationship will continue and that he / she does not feel anxious about losing his / her family's living wage. The study consists of four parts. In the first part, the conditions for benefiting from job security have been examined. In the second part, the procedure to be applied in the termination of employment contract, and in thrid part, the procedures of objection to termination have been examined. Lastly, in the fourth part, the results of the return to employment lawsuit are examined within the framework of the doctrine and judicial decisions.
