The results of the reemployment lawsuit

In this study titled "The Results of the Reemployment Lawsuit", the results of the case issued by the employee against the employer on both employer and worker are handled in full detail. In this context the Labor Law, in which the case of reinstatement is determined by the articles 20 and 21, was examined together with judicial decisions and regarded doctrine. In addition, the new regulations introduced in terms of employment lawsuits with the Labor Courts Law No. 7036 published in the Official Gazette dated 25.10.2017 and numbered 30221 have been included in the scope of our work. Some rules are created in the Labor Law to sustain the workplace and protect the worker against the termination and bad work relation. In this way both arbitrary termination is tried to be stopped and precautions are tried to be taken to compensate for negative results due to firing. While a new era has been opened in terms of contract termination, there have been some problems in practice and application. For this reason court decisions are also explored so that requirements to benefit from job security, obligatory mediation system, possible decisions in reemployment lawsuit and their consequences for worker and employer are explained. Our objective is that the results of reemployment lawsuit within the context of Labor Law arrangements and new changes in Labor Courts Law are investigated in terms of Labor Law, doctrine, practice and court decisions.
