Abstract (EN)

Furūq al-fiqhiyya is the name of the science that investigates and reveals the similar aspects of jurisprudential issues and the differences between them. Over time, it has gained prominence as a subdiscipline of fiqh. The aim of this study is to examine the history of jurisprudence in Yemen between 489 and 558 AH. 489 and 558, the aim of the study is to identify and analyze the issues of "Furūk-u fiqhiyya" in the section of worship in the work "al-Bayân" of Imrânī, a member of the Shâfi'i sect who lived in Yemen between 489 and 558. For this reason, first of all, the examples related to furūk-u fiqhiyya in the work are analyzed. The next step is to classify the examples that fulfill the conditions of furūk according to the subject headings. Then, the nuance that causes similar issues to be ruled differently is explained. The study consists of an introduction and three chapters. The introduction provides information about the subject, purpose, scope and importance of the study. In the first chapter, the scholarly and political situation of the society in which Imranī lived, the author's life, his works, and his teachers are explained. In the second chapter, the nature and importance of Furūq al-fiqhiyya, the concepts related to it, and the stages it has gone through in the historical process are discussed. In the third chapter, the book of al-Bayân in the section of worship, Kitab al-taharah, Kitab al-salât, Kitab al-janâiz. Kitab al-zakât, Kitâb al-siyâm, and Kitab al-haj, 60 examples of furūk were analyzed and each example was followed by an analysis of the issue. Since the work is large and comprehensive, only the issues that highlight the spirit and mentality of furūq al-fiqhiyya are analyzed.
