İbn Hazm's views on the "talak" court

This study focuses on the examination of "talak" provisions of Ibn Hazm's al-Muhallâ. In the first part of the study, Ibn Hazm's life, his works, his scientific studies, his understanding of the method and his contributions to Zahirî methodology were mentioned. In the same section, the content, writing and systematic of his work, al-Muhallâ, are given. In the second part, the definition of the concept of talak, the evidence of talak in the Qur'an, sunnah and ijma, similarities and differences of the concepts of talak and termination are given. Also, The concepts and types of talak's dictionary and glossary definition, and general information about these concepts is given. In the third part, the types of talak and the provisions of talak in Ibn Hazm's al-Muhallâ are examined and the provisions of other communions on these issues are given. In the fourth chapter, the reasons for the accidental divorce and its provisions in al-Muhallâ and the opinions of other communions were examined. As a result of this study, we see that Ibn Hazm reflects Zahari communion views with his own unique methodology, as in other fiqh subjects. This is because he has reflected his consistency in procedure and jurisprudence, his critical approach towards other communion imams, his method of handling issues and his harsh attitude while processing the talak chapter in this work. As in most of the fiqh issues, al-Muhallâ, which attracts attention with the abundance of rumors about talak, is a valuable work for researchers.
