Assessment of İbn Nujam's preferred opinions in el-Bahrü'r-Râʾik

The rapid spread of Islam among people, starting from the summon process, caused to emerge many different customs and traditions and in this context, it has led to the emergence of various applications and problems. Fiqh scholars have made ijtihad to solve these problems and have come to different conclusions from each other. Many different opinions have emerged on a matter between madhhabs and within the same madhhab. This situation required the scholars to choose between different ijtihad in the following period. Ibn Nujaym and his work al-Bahr al-ra'iq have an important place both in the Hanafi madhhab and in the field of Islamic Law. This study focuses on Ibn Nujaym's preferences in the aforementioned work. The aim of this study is to identify and analyze Ibn Nujaym's preferences, to show how the logic of intra-sectarian preference is applied, and to contribute to the literature by revealing the application of intra-sectarian fiqhi contemplation in the example of Ibn Nujaym. In this context, the research is limited to the author's last work, al-Bahr al-ra'iq. Despite this limitation, the author's other works have been consulted where they are thought to contribute to the purpose of the thesis. Preferences were identified using the Documentary Source Scanning method, and then important examples with high representativeness were identified and evaluated among these preferences. The study consists of an introduction and three chapters. In the introduction section, preliminary information such as the subject, importance, purpose, scope and limitations of the research is given. In the first chapter, Ibn Nujaym's life, works, scholarly direction, personality and the period in which he lived are discussed descriptively. The second section focuses on the concept of preference. After evaluating the opinions in the literature on this subject, Ibn Nujaym's thoughts on the concept of preference are tried to be revealed by referring to his works. In the third section, the preferences identified in the work, which have high representativeness, are evaluated according to the subject classification of the aforementioned work. In the conclusion section, a general evaluation is made and the findings are presented.
