Abstract (EN)

After the death of the Prophet, some of the Companions, who undertook the task of understanding and transferring The Qur'an and Sunnah to life, both produced solutions to the problems of the people in the places where they went and trained students to transfer the religion to the next generations. However, reasons such as the method of Ibn Shubrume and Uthman al-Battī, who are among the mujtahids of the 2nd century Hijri and who constitute the subject of our research, although they lived in the period of the four sect imams, their names were mentioned in the sources as the imams of the sect without followers and remained among the pages of history. understanding the nass, reaching the narration, and the preference criteria of the news evolved into different interpretations and this situation evolved into schooling. Nevertheless, the need arose to utilise the views of the aforementioned mujtahids and the like in solving some of the issues that arose. As a matter of fact, the fact that some of the opinions of the jurists who are the subject of our research were included in the Mecelle-i Ahkâm-ı Adliyye prepared in the 19th century led us to investigate the scattered opinions of these jurists, who did not have independent works, and to research them with the idea that their opinions could be presented as a solution when necessary. In this sense, the place of Ibn Shubrume and Uthman al-Battî, who lived in the same period with Abu Hanifa, in the science of fiqh has been tried to be determined. In the first part of our thesis titled 'Comparison of Ibn al-Shubrumu and "Uthman al-Battī's understanding of usul and jurisprudence", the period in which Ibn al-Shubrumu and "Uthman al-Battī lived, their lives, their scholarly personalities, their teachers and students; in the second part, Ibn al-Shubrumu and "Uthman al-Battī's understanding of usul, and in the third part, Ibn al-Shubrumu and 'Uthman al-Battī's jurisprudence that we have been able to identify are given in detail and then they are compared.
