Abstract (EN)
Ibn al-Humam, who lived in the ninth century (Hijrah), is a prominent Hanafi scholar of fiqh. One of his most important works, no doubt, is the annotation of Mergınani?s (593/1197), al-Hidaye, called Feth al-Kadir.Ibn al-Human had begun to write Feth al-Kadir in 829 and was able to complete his annotation up to the section of ?vekale?. The remaining portion of the work was completed in Netaicu al-Efkar by Kadızâde (988/1580). But in the end, it can be said that most of al-Hidaye -almost three fourths- was annotated by İbn al-Humam.Ibn al-Human kept the content arrangement of al-Hidaye, but when he deemed necessary, he discussed subjects which were not present in the original work. Also, Ibn al-Humam had put forward evidences not included originally about the subjects. Evaluations of these evidences were also transmitted by him. Each issue is presented with evidence in his work which indicate that Ibn al-Humam had defended his denomination without falling into sectarian bigotry.On the other hand, Ibn al-Humam had also included opinions of scholars of other denominations which had not been mentioned in al-Hidaye. So it can easily be said that Ibn al-Humam?s work was not only a classic annotation, but an important comparative work of fıqh.This thesis aims at examining these significant features as they make Fathu?l-Kad?r a unique work of fiqh.
