Abstract (EN)

This study titled "Pledge Deficit Document in Enforcement Law " consists of four sections. In this study, the pledge deficit document (final) regulated in the article 152 of the Code of Enforcement and Bankruptcy and the temporary pledge deficit document regulated in the article 150/f of the CEB are examined by taking account of the comments in the doctrine and judicial decisions. In the first section, general information regarding the definition of right of pledge, applicable principles in the law of pledge and the scope of the receivable secured by the pledge are described. In the second section, the relation between the regulations regarding the temporary pledge deficit document and final pledge deficit document upon the appeal of pledgee to legal proceeding by means of foreclosing of the pledge prepared in the article 45 of the Code of Enforcement and Bankruptcy has been discussed with the consideration of the balance of interests in the law of compulsory enforcement. In the third section, the definition, the legal nature, regulation, effects and consequences of the final pledge deficit document are conveyed. In this section, the regulation terms, and their legal consequences on their realization in terms of code for quashing are being emphasized. Moreover, information has been provided by examining the document with the terms on material law regarding the receivable linked to this document. In the last section of our study, the definition of temporary pledge deficit document, its regulation and the effects and consequences that arise on law of compulsory enforcement have been described.
