The Data owner's right to compensation in the context of the responsibility of the administration and the state in criminal proceedings

In the criminal procedure process, a lot of personal data is processed in the investigation of material truth. This study aims to reveal the compensation liability of the administration and the state in terms of personal data processed in the criminal procedure process. In the study, the legal obligations and the rights of data owners regarding the protection of personal data processed within the scope of judicial and administrative activities in the criminal procedure process are discussed; within the framework of the right to protection of personal data, the compensation of material and moral damages arising in the event of unlawful data processing is emphasized. The legal regulations in Turkey are examined in comparison with international legislation, and the right to compensation of the data owner is questioned in the context of the responsibility of the administration and the state in the criminal procedure process.
