Constitutional basis of the responsibility of the administration

The purpose of our study is to determine the constitutional limits of the responsibility of the public power by taking into consideration historical development of the responsibility of the administration towards individuals concerning its actions and practices as well as the reasons of this responsibility and by considering the basis of the responsibility of the administration within the domain of positive law and particularly the constitutional regulations.The study is formed of two parties. In the first part of the thesis, historical development of the responsibility of the administration, defect liability in general and absolute liability principals are examined.In the second part, regulations concerning the responsibility of the administration under the positive law are discussed.Various opinions regarding the basis of the responsibility of the administration are expressed. As the basis of the responsibility of the administration, principals like ?state of law?, ?equality before public obligations?, ?Equal opportunity and chance? are raised.
