Abstract (EN)
Purpose of the liability law is to provide compensation of actual damages which caused by the use of public power. Although in the Turkish Positive Law as constitutional and legal, the responsibility of the administration has been put forward, the princibles of provisions of the liability has not been included. Task to remedy the loopholes in the subjects forming the princibles of the liability is assigned to judicial bodies and the doctrin makes such caselaws systematic. Damage means, the negative difference between the next aspect and the beore when the violation occured in the tangible and intangible assets which are under the legal auspices. Although the damage is foreseen as a condition that can be determined clearly and easily it can be understood that damage is a well-rounded concept when we try to name and designate its attributes. In this regard, responsibility of the administration of compensation and responsibility of the administration of the compensation arrangement in the Constitution, what the damage is expressed, due to administrative procedures or who acts or who has suffered constitutes the scope of this work.
