Abstract (EN)
In this study which we analyze ?violation of interest? in administrative justice in terms of annulment action, the concept of ?violation of interest? was defined and definition of ?violation of rights? especially the aim of annulment action and importance of ?violation of interest? in terms of the principle of the rule of law were taken into consideration.Also, law amendment relating to narrow the possibility of bringing an action in terms of subjective capacity in annulment action and annulment of this law amendment by the Constitutional Court and importance of ?violation of interest? concept in terms of the principle of the rule of law.The definition of ?violation of interest? concept which is provision of subjective capacity in annulment action was analyzed with the meaning and content of concept and also mentioned court decisions and different point of view in doctrine about characteristics of ?violation of interest? which are legal, current and personal. Furthermore, this study examined the ?violation of interest? in terms of plaintiff and types of administrative acts which is subject of the action. Lastly, ?violation of interest? was evaluated in accordance with close and extensive interpretation of this concept, judicial supervision of administration and implementing the principle of the rule of law.Key Words1.Annulment Action2.Subjective Capacity3.Violation Of İnterest4.Legal, Current And Personel İnterest5.(The Principle Of The) Rule Of Law
