Temporal execution of annulment and stay of execution decisions in administrative jurisdiction

The execution of administrative jurisdiction decisions has been a subject extensively debated in doctrine and judicial rulings. However, these discussions have primarily concentrated on the problem of non-implementation of judicial decisions and the solutions proposed to address this issue. This concentration of debates has resulted in insufficient attention being paid to the temporal execution of administrative judicial decisions. The present study examines the rationales for retroactivity—which is the principle in the temporal execution of administrative judicial decisions—the principles it affects, and the potential limitations to this rule.
