Abstract (EN)
For the principle of rule of law completely settled, the administration must keep law and should be judicial control of the administration. According to the provisions of the Constitution, the State Council is the top of the administrative justice and all activities and acts of the administration can be judged. So the legislature has no right of discretion to change the jurisdiction of an administrative dispute by violating the Constitution.To determine the jurisdiction of the court importance is the nature of the dispute. Considering that the 1982 Constitution accepts the separation of the administrative jurisdiction, therefore, the change in jurisdiction is not only a technical procedure. The problem relates to the principle of rule of law, then we need to raise the constitutional basis of the competence of the administrative jurisdiction
